By accessing or using MyRealHQ ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including property managers, tenants, and vendors.

2. Description of Service

MyRealHQ is a real estate transaction management platform that provides:

  • Maintenance request intake via voice, SMS, and web forms
  • AI-powered triage and categorization of maintenance requests
  • Automated vendor assignment and notification
  • Tenant and vendor communication management
  • Reporting and analytics tools
  • Property and unit management features

3. User Accounts and Registration

3.1 Account Creation

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use this Service.

3.3 Account Security

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

4. SMS and Voice Services Terms

4.1 Consent to Receive Messages

By providing your phone number and using our Service, you expressly consent to receive SMS text messages and voice calls from MyRealHQ related to:

  • Account notifications and security alerts
  • Maintenance request confirmations and status updates
  • Vendor assignments and estimated arrival times
  • Service completion notifications
  • System updates and service announcements

4.2 Message Frequency

Message frequency varies based on your account activity, property portfolio size, and maintenance request volume. You may receive multiple messages per day during active maintenance requests.

4.3 Message and Data Rates

Message and data rates may apply. Standard messaging and data rates from your mobile carrier will apply to all SMS messages sent and received through the Service. MyRealHQ does not charge for messages, but your carrier may. Contact your mobile carrier for pricing details.

4.4 Opt-Out Instructions

You may opt out of receiving SMS messages at any time by:

  • Texting STOP to any message from MyRealHQ
  • Updating your notification preferences in your account settings
  • Contacting our support team at support@myrealhq.com

After opting out, you will receive one final confirmation message. Please note that opting out may impact your ability to receive critical service updates and may affect the functionality of the Service.

4.6 Supported Carriers

Our SMS services are supported by major U.S. mobile carriers. While we strive to support all carriers, message delivery may vary based on your carrier's network and policies.

4.7 No Marketing Messages

MyRealHQ will not send marketing, promotional, or advertising messages via SMS. All messages are strictly transactional and service-related.

4.8 Voice Call Recording

By using our voice services, you consent to the recording of calls for quality assurance, training, and dispute resolution purposes. Calls may be transcribed and stored in accordance with our Privacy Policy.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service for any fraudulent or illegal activities
  • Transmit spam, junk mail, chain letters, or unsolicited messages
  • Upload or transmit viruses, malware, or other harmful code
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any portion of the Service
  • Impersonate any person or entity or misrepresent your affiliation
  • Harass, threaten, or abuse other users
  • Scrape, crawl, or use automated tools to access the Service

6. Payment and Billing

6.1 Subscription Plans

The Service is offered on a subscription basis. Pricing and plan details are available on our pricing page and are subject to change with 30 days' notice.

6.2 Payment Terms

You agree to pay all fees associated with your subscription plan. Payments are processed through our third-party payment processor (Stripe). By providing payment information, you authorize us to charge your payment method for all fees incurred.

6.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate.

6.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial months or unused portions of the Service, except as required by law.

6.5 Free Trial

If you sign up for a free trial, you will have access to the Service for the trial period. Unless you cancel before the trial ends, you will be automatically charged for the subscription plan you selected.

7. Intellectual Property Rights

7.1 Ownership

The Service, including all content, features, and functionality, is owned by MyRealHQ and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

7.2 User Content

You retain ownership of any content you submit to the Service (e.g., maintenance requests, messages, property data). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing the Service.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Third-Party Services

The Service integrates with third-party services (e.g., Twilio for SMS, Stripe for payments). Your use of these services may be subject to additional terms and conditions imposed by the third-party providers. We are not responsible for the actions, policies, or content of third-party services.

10. Disclaimers and Limitations of Liability

10.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

10.2 No Guarantee of Results

While we strive to provide accurate and reliable service, we do not guarantee specific outcomes, response times, or vendor availability. The Service is a tool to facilitate communication and coordination; ultimate responsibility for property maintenance remains with the property manager.

10.3 Limitation of Liability

To the maximum extent permitted by law, MyRealHQ and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

10.4 Indemnification

You agree to indemnify and hold harmless MyRealHQ from any claims, damages, liabilities, and expenses (including attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease, and we may delete your account and data in accordance with our data retention policies.

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court for infringement of intellectual property rights.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyRealHQ regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms at any time without notice.
